California and Massachusetts are getting ready to sue the Trump administration over the brand new $100,000 H-1B visa utility payment, saying the measure imposes an illegal burden on employers and was enacted with out the required rulemaking course of.
The lawsuit, scheduled to be filed Friday, would be the first authorized problem to the charges by a U.S. state. This follows a lawsuit filed in October by the U.S. Chamber of Commerce, a coalition of labor unions and staffing firms, which continues to be pending.
The H-1B visa program permits U.S.-based employers to rent overseas employees in specialised fields. In September, President Trump introduced a sweeping overhaul of the system, arguing that it has been exploited on the expense of American employees.
